REGULAR SESSION MINUTES
PLANNING AND ZONING COMMISSION
FEBRUARY 8, 2012

A Regular Session Meeting of the EAST HARTFORD PLANNING AND ZONING COMMISSION was held in the Town Council Chambers, 740 Main Street, East Hartford, Connecticut on February 8, 2012.

The meeting was called to order at 8:38 p.m.

ROLL CALL

CALL TO ORDER

Chairman Anthony Kayser declared a quorum present. Chairman Kayser stated that Mary Whaples would be voting in place in Kathy Salemi and be acting secretary, and Crystal Hernandez would be voting in place of Paul Roczynski. Additionally, Chairman Kayser stated that the Commission would be voting with seven members.

Upon a motion by Thomas Fitzgerald seconded by Mary Whaples, the Commission Voted (7-0) to Approve the above minutes.

Workshop Meeting – January 25, 2012

Upon a motion by John Grottole seconded by John Ryan, the Commission Voted (4-0) to Approve the above minutes. Pete Bonzani, Tom Fitzgerald, and Mary Whaples did not vote due to their absence at the meeting.


Design Review Committee Member

Upon a motion by Tom Fitzgerald, seconded by Pete Bonzani, the Commission Voted (7 -0) to appoint  Larry Frazier  as the Design Review Committee Member.

SPECIAL PERMIT APPLICATION: Under Section 304.2 to allow an adult day-care facility on land ~located at 870 Burnside Avenue. ~~~~~~~~
Assessor’s Map #48 Lot# 352
Applicant: Tarequl Ambia
(Applicant Postponed From the January 11, 2012 Meeting)

Upon a motion by John Grottole, seconded by John Ryan, the Commission Voted (7-0) to Approve the above Special Permit Application with the following conditions:

1.      Final plans are to be signed and sealed by the Land Surveyor, Professional Engineer, and Architect who is responsible for the work.
2.      Provide separate plan sets for each application and label them accordingly.
3.     Maximum number of clients shall not exceed fifty six (56).

SITE PLAN APPLICATION –  870 Burnside Avenue, Installation of an entrance canopy, site lights and ground sign panel replacement to an existing commercial building.
Applicant: Lorri DiBattisto

Upon a motion by John Grottole, seconded by Tom Fitzgerald, the Commission Voted (7-0) to Approve the above Site Plan Application with the following conditions:

1.      In evaluating this application, the Planning and Zoning Commission has relied upon information provided by the applicant and, if such information subsequently proves to be false, deceptive, incomplete, and / or inaccurate, this permit shall be modified suspended or revoked.
2.      Final plans are to be signed and sealed by the Land Surveyor, Professional Engineer, and Architect who is responsible for the work.
3.      Provide separate plan sets for each application and label them accordingly.
4.      On the site plan, provide construction details for all proposed site improvements.  Details shall include but not be limited to concrete light base, fence, gate, pipe rail, sign and mounting detail.
5.      On the site plan, add additional layout dimensions for the layout and location of the relocated shed.
6.      On the site plan, revise the notes to add a note specifying that all disturbed areas are to receive 6” of topsoil and turf is to be established.

7.      On the site plan, specify to repair or replace the existing site light that is located to the east of the entrance driveway.  Revise the photometric plan to demonstrate that the proposed parking lot lighting meets requirements outlined within the zoning regulations.
8.      On the site plan, revise the dumpster enclosure detail to specify what fence material will be used and provide a construction detail for the fence and proposed gate.
9.      On the site plan, specify which lights are to be replaced and provide a detail for a concrete light pole foundation, additionally specify which lights are to be shielded.
10.     On the site plan, provide more detail on the construction of the proposed canopy.
11.     On the site plan, graphically depict the intersection sight distance specified within the traffic report.
12.     On the site plan, add a note to the plans specifying that this site plan and special use approval is for a facility serving a maximum number of 56 clients.
13.     On the photometric plan, provide a site plan approval block and specify which lights are to be replaced, revise the plan to include shielding the fixtures adjacent to the property line.
14.     Within the traffic report, Demonstrate there is adequate on-site queue length for vehicles stacked at the proposed drop off/pick-up area.
15.     Within the traffic report, provide the latest three-year accident history on Burnside Avenue in the vicinity of the subject driveway.  Summarize the results and discuss whether there is a trend which needs to be addressed to facilitate the proposed site improvements.
16.     Site Improvement Bond set in the amount of $11,000.00.

SPECIAL PERMIT APPLICATION: Under Section 406.1a (10) and section 222 to allow alcoholic beverages associated with restaurant/eating establishment on land located at 1016 Main Street.

Applicant: Carlos Costa

Upon a motion by Mary Whaples, seconded by Tom Fitzgerald, the Commission Voted (6-1) to Approve the above Special Permit Application with the following condition: (John Grottole voted in opposition to the motion)

1.      On the list of property owners within 200’ add information for the following properties: Map 13 Lot 259 and Map 13 Lot 293.

TEXT AMENDMENT APPLICATION: Under Section 702.2 to allow determinations to be made by the Site Plan Review Committee and emergency repairs determinations from the Zoning Enforcement Officer.

Upon a motion by Pete Bonzani, seconded by Mary Whaples, the Commission Voted (7-0) to Approve the above Text Amendment Application with an effective date 15 days after advertisement of the decision..

MISCELLANEOUS

  • 303 Burnham Street Site Plan Modification Bond Release Request
Applicant: PDS Engineering & Construction

Upon a motion by Pete Bonzani, seconded by Tom Fitzgerald, the Commission Voted (7-0) to Approve the above Bond Release in the amount of $13,310.00.


CORRESPONDENCE

Staff discussed with the Commission a letter from State of Connecticut Department of Transportation District I dated February 3, 2012 regarding Sanitary Sewer Improvement to Main Street to High Street Service. It was the consensus of the Commission to acknowledge receipt.

Staff also discussed letter from State of Connecticut  State Traffic Commission Department of Transportation  Dated January 6, 2012 regarding a building square footage discrepancy and one parking space for the Academy for Advanced Design & Technology / UTC Willgoos ECS Office Lab. It was the consensus of the Commission to have staff respond to the State of Connecticut State Traffic Commission Department of Transportation indicating that the new revised 80,075 square footage and the elimination of one parking space is acceptable.

Staff additionally, discussed new language changes to section 228.2 General Requirements for Drive-Through Facilities subsection h. It was the consensus of the Commission to have staff move forward with a text amendment application.
